Famclaim
Creator Terms of Service
Effective date: 3 November 2026 · Last updated: 3 November 2026
1. About these Terms
These Terms are between Famclaim Ltd (“Famclaim”, “we”) and you, the creator or organisation that opens a Famclaim account (“you”). By ticking the box at sign-up or using the Services you accept them, together with the Privacy Policy and the Data Processing Addendum (the “DPA”). “Services” means famclaim.com, your hub, the dashboard, and related tools. “Fans” are people who join your fam. “Fam list” is the list of Fans who joined your hub.
2. Your account
- You must be 18 or over and give accurate details. Keep your login secure and tell us promptly about any unauthorised access.
- You may not take a hub name that impersonates someone else or infringes a trademark. We may reclaim or change a name for that reason.
- Each account is for one creator or business.
3. Your hub and content
You own your content. You give us a non-exclusive licence to host, display and deliver it through your hub, solely to run the Services. You promise you have the rights to everything you upload and that it is lawful. We may remove content that breaks these Terms or the law, and will tell you where we can.
4. Your fam: your responsibilities
Fans give their details so that you can contact them. For your fam list you are the controller and we are your processor, under the DPA. You are responsible for:
- having a lawful basis, and for email marketing the Fan’s consent, before you email them, and using Famclaim’s sign-up wording or wording at least as clear;
- honouring every unsubscribe and erasure request, and never re-adding someone who has opted out;
- complying with UK GDPR, PECR and, where you email people in other countries, the laws there (for the US, CAN-SPAM);
- not collecting special-category data (health, religion, sexual orientation, political opinion and similar) or children’s data through your hub, and not directing your hub at children under 13;
- not uploading, buying or importing lists of people who did not join through your hub, and not sharing or selling your fam list to third parties for unrelated purposes.
Your fam list is yours. You can export it at any time on every plan, including free, and for 30 days after you close your account. We store it on your behalf and do not use it for our own marketing.
5. What you must not do
Do not use the Services unlawfully; send spam or misleading messages; use keywords or content that deceives Fans; upload malware or illegal, hateful, infringing or sexually explicit content; scrape or break our security; reverse engineer the Services except as the law allows; or resell the Services without our permission. You must also follow the rules of any platform where you share your link.
6. Plans, fees and referrals
- Plans and prices are on famclaim.com/pricing. Paid plans are billed through Stripe in advance, monthly or as stated at checkout, and renew automatically until you cancel. Prices include or exclude VAT as shown at checkout.
- You can cancel at any time in your dashboard; the plan runs to the end of the period you paid for. We do not give refunds for part-used periods except where the law requires. If you are a consumer, you have a 14-day right to cancel a new subscription, but if you ask us to start straight away you must pay for the service used in that time.
- Plans have limits (for example, the number of fams). If you downgrade or reach a cap we will never delete your Fans: new sign-ups may be limited until you upgrade or are back under the cap.
- Referrals: you get a referral link. Rewards (such as a larger fam cap or free months) are earned only when a creator you refer activates or subscribes, as set out in the Referral terms. Rewards have no cash value, cannot be sold, and may be withdrawn for self-referral, fake accounts or other abuse. We may change the programme with notice, but will honour rewards you have already earned.
- Free hubs may show a “Powered by Famclaim” badge and prompts inviting Fans to share Famclaim.
7. The Services and third parties
We aim to keep the Services available but do not promise uninterrupted service. We rely on providers and on platforms such as Instagram, TikTok, YouTube and X, and we are not responsible for changes they make. Your Famclaim link and fam list work independently of any platform.
8. Our property
We and our licensors own the Services, software, brand and documentation. We grant you a limited, non-exclusive, non-transferable licence to use them under these Terms.
9. Warranties and liability
- We will provide the Services with reasonable care and skill. Beyond that, and so far as the law allows, the Services are provided “as is” and “as available”.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be limited, or your statutory rights as a consumer.
- Subject to that, we are not liable for loss of profit, revenue, goodwill or data, or for indirect or consequential loss. Our total liability to you in any 12 months is limited to the fees you paid us in the previous 12 months, or £100 if you are on the free plan.
10. Indemnity
If a third party (including a Fan or a regulator) makes a claim against us because of your content, your use of your fam list in breach of these Terms, or your breach of the law, you will cover our reasonable losses, unless we caused the problem.
11. Suspension and ending
You can close your account at any time. We may suspend or end it if you materially break these Terms and do not fix it within 14 days of notice, or immediately for serious or unlawful abuse. After closure you have 30 days to export your fam list; then we delete data as the Privacy Policy and DPA describe.
12. Changes and general terms
We may update these Terms. We will give at least 30 days’ notice of material changes by email; if you don’t agree, you can close your account. These Terms and the documents they refer to are the whole agreement. If a provision is unenforceable the rest still applies. Nobody else can enforce these Terms. We are not liable for events outside our reasonable control.
13. Governing law and contact
These Terms and any dispute are governed by the laws of England and Wales and the courts of England and Wales, except that UK consumers may use their local courts. Contact: Famclaim Ltd, 34 Yarrow Road, ME5 0RY, United Kingdom; support@famclaim.com; legal@famclaim.com.
